  • If a platform is repeatedly notified about defamatory content and does nothing.

  • Yeah, I think that’s a killer, Jack.
  • violations of their own terms. If a platform claims to prohibit defamation, but fails to enforce those rules consistently, how about, say, 600 or 700 times?

  • Might argue the platform is engaging in a deceptive practice or breach of contract. Yes.
  • Refusal to remove after court order.
  • Once a judge rules that content is defamatory, platforms are expected to comply. Refusal to remove such content could lead to contempt of court or further legal penalties. Real-world examples.
  • Rumble has faced lawsuits alleging it ignored takedown requests and allowed harmful videos to remain online.
  • BitChute has been criticized for hosting content that violates privacy and defamation laws, with some cases escalating to legal action. So, yes.
  • If a plaintiff can show that the platform knowingly allowed defamatory content to persist and contributed to the harm, liability becomes a real possibility.

  • not meeting that standard. We can’t do it, and it’s obvious. Free speech framing.
  • Rumble, for example, positioned itself as a free speech platform and has countersued critics for defamation, arguing that attacks on its moderation policies are politically motivated, not here, not here.
  • So while plaintiffs have a compelling narrative and some legal traction, success will hinge on whether they can prove that these platforms cross the line from passive hosts to active enablers of defamation. If they do, it could set a major precedent.

  • Well, it’s still a high bar, given that, A, you’re going to… even though we can see that they’ve modified their algorithm, you’ll have to have somebody who’s, aware of how algorithms work.
  • as your, … as somebody who actually is an expert witness, because just for you and me to say that’s the case, they could simply say, no, it’s not. But we both know that that’s not the way it works.

  • And in Discovery, they gotta reveal their algorithms and what they had in the past. They can’t hide here. With Discovery, I can have them expose every damn video they ever had about vodka and what they did about it, how many complaints they got.
  • about my cease and desist orders, about my… here’s a key thing, Jack, and I mentioned this last week, but it bears repeating.
  • The affidavits I filed with the court.

  • Were not contested or disputed.
  • That means they have legally forfeited the right to contest them. They have, in effect, admitted or acknowledged them to be accurate.
  • I think it was a huge mistake on their part.
  • They thought they were being clever, because I wasn’t doing everything properly.

  • My intent was to file a motion for a default judgment if they didn’t respond. Well, that’s what’s gonna happen here.
  • If, as you surmise, even after the case is docketed.
  • They don’t respond. I’ll file a motion for default judgments.
  • And that means they’ll lose the case.
  • By failing to respond.
  • But I’m telling you, Jack, the evidence in this case is so massive.
  • the offenses are so egregious, I think they’re gonna wanna settle. They’re gonna wanna settle. They say, Mr. Fetzer, Dr. Fetzer, what’s it gonna take?
  • to keep this out of court. I… I think, Jack.
  • And I ain’t gonna treat them easily.
  • I think $59 million would be a good word for them.
  • That’s fine.
  • That’s 30 million punitive, and as we’re filing for 10 mil.
  • But punitive can triple it to 30 apiece. That’s where the 60 came from. But see, that’s Vacca’s style. He didn’t say I was soon a pretend pill, which is what I’d originally announced. He wants to take everything and exaggerate it as much as he can to make it easier to attack, right?

  • And he’s not even explaining that’s $30 million apiece, because of triple damages, because of their complicity and failure to take corrective… he will never explain any of that, see?

  • I did a wonderful interview with Dr. Catherine Hort, and she’s a PSE particle physicist from Oxford.

  • And it was just incidental, before we did an interview last week, that I mentioned to her, she asked me how I was doing, and I was explaining that.
  • Well, I gotta deal with this lawsuit with this guy. She didn’t know anything about it! So, she started looking at it. When she started looking at all the videos, she said, right off the bat, those are AI-generated covers.
  • AI-generated covers. They’re too many, they’re coming out too fast. She’s gotta be right. And she was saying she thinks that this is an FBI operation, and Vaka’s the front guy. And I’m… I’m telling her, I think, no, it’s actually Mossad.
  • I don’t think it is FBI. I actually think it’s Mo Saad.
  • And as I explained there, my Sandy Oak friends told me that Sandy Oak Promise had hired Victor to attack me, because they’re worried that my lawsuit
  • maybe reversed, and it might cut off the gravy train where they’re making a million bucks a month, Jack, on Sandy Hook. They’re still making a million bucks a month!

  • Well, it’s a huge scam. I’ve always been the big… Alex Jones was never that big a threat, except he had a huge audience. I was the one bringing together the experts, producing the evidence, and you know.

  • None of them wanted me, Jack. None of them wanted me. The insurance company were more eager to give up 77 mil than they were to have me expose the whole thing was a sham. Why?
  • I’m convinced because they think, in the end, it’s gonna lead to insurance for holding weapons, handguns, rifles, and they’re gonna make billions!

Another PSYOP is that Israel is God’s chosen people, and that they… they’re doing any kind of good at all, when they’ve been the bane of humanity for 2,000 years or more.
